Welcome to Calorichat, an AI-powered virtual nutrition assistant that provides personalized guidance for calorie tracking, nutrition goals, and healthy eating advice through WhatsApp.

The Calorichat service is offered by Astravia LLC, a limited liability company («LLC») formed in the State of Wyoming, United States.

These Terms of Service («Terms») govern your access to and use of the Calorichat application, its features, functionality, content, and related services (collectively, the «Service»). By using our Service, you agree to comply with these Terms. If you do not agree with any part of these Terms, you may not use our Service.

• «Service» — «Service» refers to the Calorichat application, including all its functionality, content, and services available through WhatsApp and the web platform.
• «User» / «you» — «User» or «you» refers to any person who accesses or uses our Service.
• «We» / «us» / «our» — «We», «us», or «our» refers to Astravia LLC (Wyoming, USA), operator of the Calorichat service, and its owners, affiliates, successors, and assigns.
• «AI» — «AI» refers to the artificial intelligence technology that powers our Service.
• «Content» — «Content» refers to all information and data provided through the Service, including text, images, recommendations, and other materials.

3.1. Eligibility requirements

To use our Service, you must:

• Be at least 18 years of age
• Have an active WhatsApp account
• Provide accurate and complete information when requested
• Comply with these Terms and all applicable laws

3.2. Acceptable use

By using our Service, you agree to:

• Use the Service only for personal, non-commercial purposes related to calorie tracking, nutrition, and personal health
• Not use the Service for any illegal or prohibited purpose under these Terms
• Not attempt to access, manipulate, or use non-public areas of the Service
• Not interfere with the normal operation of the Service
• Not automate or script interactions with the Service without authorization
• Not collect or store personal information of other users

4.1. Service description

Calorichat is an AI-powered virtual nutrition assistant that offers:

• Answers to nutrition and healthy eating queries
• Food identification and nutritional analysis from photographs
• Calorie and macronutrient tracking
• Nutrition goals and health objective tracking
• Personalized nutrition tips and advice
• Meal logging reminders

4.2. Service limitations

You understand and agree that:

• The Service provides general nutrition and dietary information and does NOT constitute professional medical advice
• Food identification and nutritional analysis are estimates based on the information provided and may contain inaccuracies
• The accuracy of the Service depends on the quality of photographs and information you provide
• Before making significant changes to your diet or health routine, you should consult certified medical professionals you trust
• The Service must NOT be used as a substitute for professional medical diagnosis, treatment, or advice
• We are not responsible for health decisions made solely on the basis of information provided by the Service
• If you have medical conditions, serious food allergies, or are under medical treatment, you must consult your doctor before following any recommendation from the Service

4.3. Free tier limits

On the free tier, use of the Service via WhatsApp is subject to daily limits:

20 text messages per day and 3 meal analyses (photos) per day.

On the web platform, the free tier allows viewing and editing meals and calories; adding meals manually, AI nutrition plan, and macronutrient breakdown are available only on the premium plan.

5.1. Subscription plans

We offer subscription plans (including a free plan with usage limits and a premium plan) to access our Service. Plan details are available on our website.

5.2. Free trial

The premium plan may include a 7-day free trial. A valid payment method is required when signing up. If you do not cancel before the end of the trial period, you will be charged the subscription fee automatically. We may send you trial reminder messages via WhatsApp (e.g., 24 hours and 2 hours before the trial ends) in your language; by using the Service you agree to receive these subscription-related communications.

By completing payment at Stripe Checkout, you confirm that you have accepted these Terms of Service as part of the checkout process.

5.3. Payment process

When subscribing to our Service:

• You agree to pay all fees associated with the selected plan
• You authorize us to charge the payment method provided
• You confirm that the payment information provided is accurate and that you are authorized to use the indicated payment method

5.4. Renewal and cancellation

Subscriptions renew automatically at the end of each billing period (monthly or yearly) unless you cancel. Cancellation and subscription management (cancel, change plan, update payment method) must be done exclusively on the web platform, via the Stripe billing portal (accessed from the Calorichat dashboard) or by contacting support by email. The WhatsApp channel is for nutritional and meal use of the bot only; you cannot cancel or manage your subscription via WhatsApp.

5.5. Refunds

Refund requests are evaluated within 48 hours of the last charge and according to low-usage criteria (fewer than 5 text messages and fewer than 2 meal analyses since that charge). Refunds are processed through our support team; you may contact us by email to request a refund. There is no automatic money-back guarantee; each case is evaluated according to our internal policy.

Your privacy is important to us. Our use of your personal information is governed by our Privacy Policy, which you can find on our website. By using our Service, you consent to the practices described in our Privacy Policy.

7.1. Our rights

The Service and all its content, features, and functionality are owned by Calorichat, its licensors, or other providers and are protected by the intellectual property laws of the United States (Wyoming), Colombia, and internationally. You are granted no ownership rights in the Service or its content.

7.2. Your rights

You retain all rights to the content you submit to the Service, such as photos of your meals. However, by submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute such content in order to provide and improve the Service.

To the maximum extent permitted by law, Calorichat and its affiliates, employees, directors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

Calorichat does not guarantee that the Service will be uninterrupted, error-free, or secure. The Service is provided «as is» and «as available» without warranties of any kind, express or implied.

Medical disclaimer: Calorichat is not a medical provider and does not provide medical advice, diagnosis, or treatment. The information provided by the Service is for informational and educational purposes only. You acknowledge that any reliance on such information is at your own risk. Always consult certified medical professionals before making decisions related to your health, diet, or physical condition.

9.1. Payment processor

We use Stripe, Inc. («Stripe») to process subscription payments. Charges are processed through Astravia LLC's Stripe account. By making a payment through our platform, you are also subject to Stripe's terms and conditions and privacy policy, available at stripe.com/legal and stripe.com/privacy.

9.2. Automatic renewal

By subscribing, you agree that:

• Your subscription will renew automatically at the end of each period (monthly or yearly), unless you cancel before the renewal date
• You will be charged the current subscription fee in the chosen currency (USD, EUR, or COP, as available) at the time of renewal
• You will receive advance renewal notices when applicable

9.3. Subscription cancellation

You must cancel or manage your subscription on the web platform:

• From the Calorichat dashboard, via the Stripe Customer Billing Portal
• By contacting our customer support by email

You cannot cancel or manage your subscription through the WhatsApp chatbot; that channel is for nutritional and meal use only. Upon cancellation, you may continue to use the service until the end of the current billing period. We do not offer prorated refunds for unused time, except where required by law.

We reserve the right to modify or replace these Terms at any time. We will notify you of any material changes by updating the «last updated» date on this page or by sending a notice by email or through the Service.

Your continued use of the Service after such changes take effect constitutes your acceptance of the new Terms. If you do not agree to the new terms, you must stop using the Service.

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms.

All provisions of these Terms that by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to conflict of law principles. The Service is operated by Astravia LLC, a Wyoming LLC.

Any legal dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the State of Wyoming, United States, unless the law applicable in your place of residence requires otherwise.
